When you opt in to receive text messages from Labelle Jewelers, you may receive SMS and MMS messages related to your ring design, saved configurations, appointment scheduling, order updates, and related communications from Labelle Jewelers. These messages are sent to help you stay connected with Labelle Jewelers regarding your jewelry inquiry.

4. Consent & Opt-In

By checking the SMS consent checkbox on the Labelle Jewelers ring builder and providing your phone number, you expressly consent to receive text messages from Labelle Jewelers at the phone number you provided. Consent is not a condition of purchase or use of the ring builder tool. You may use the ring builder without opting in to text messages.

5. Message Frequency

Message frequency varies depending on your interaction with Labelle Jewelers. Typical messages include appointment confirmations, follow-ups on saved ring designs, and responses to your inquiries. You will not receive more than 3 messages per month unless you initiate additional conversations.

6. Message & Data Rates

Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan. Labelle Jewelers is not responsible for any fees charged by your carrier.

7. Opt-Out

You can opt out of receiving text messages at any time by replying STOP to any message you receive from Labelle Jewelers. After sending STOP, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again. If you experience any issues opting out, contact us using the information below.

9. Supported Carriers

11. Eligibility

12. User Responsibilities

You are responsible for ensuring that the phone number you provide is accurate and up to date. Labelle Jewelers is not responsible for undelivered messages resulting from an incorrect or outdated phone number. You agree to notify Labelle Jewelers promptly if your phone number changes.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Labelle Jewelers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the text messaging program, including but not limited to damages for loss of profits, data, or other intangible losses, even if Labelle Jewelers has been advised of the possibility of such damages. Labelle Jewelers is not liable for any delays or failures in the delivery of messages, as delivery is subject to effective transmission by your wireless carrier.

14. Disclaimer of Warranties

The text messaging program is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Labelle Jewelers does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

15. Indemnification

You agree to indemnify, defend, and hold harmless Labelle Jewelers and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your participation in the text messaging program, your violation of these Terms and Conditions, or your violation of any applicable law or regulation.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.

17. Changes to Terms and Conditions

Labelle Jewelers reserves the right to modify or discontinue the text messaging program at any time. In the event of any changes to these terms, an updated version will be made available at this page. Continued participation in the program after changes constitutes acceptance of the revised terms.

18. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
